By accessing, browsing, creating an account, submitting information, purchasing, or otherwise using the Site, you agree to these Terms and our Privacy Policy (incorporated by reference). If you do not agree, do not use the Site.
2. Additional Terms
We may present additional terms for specific programs, services, or products (“Additional Terms”). If any Additional Terms conflict with these Terms, these Terms control unless the Additional Terms expressly state otherwise.
3. Eligibility
You must be at least 13 years old to access or use the Site. To make a purchase, you must be at least 18 years old (or the age of majority in your jurisdiction). If you are under the age of majority, a parent or legal guardian must complete the purchase and agree to these Terms on your behalf.
4. Exclusively Handmade Products
Our products are handcrafted by skilled artisans using traditional methods. Variations in grain, color, or texture—as well as knots, minor cracks, or tool marks—are inherent to solid wood and artisanal processes and are not defects.
5. Accounts, Security, and User Conduct
5.1 Account Information and Security
You may need an account to access some features. You’re responsible for all activity on your account and for safeguarding credentials. Report unauthorized use to info@hervanity.com or 1-877-51-VANITY.
5.2 Use of the Site (License & Prohibited Conduct)
We grant a personal, limited, non-exclusive, non-transferable license to access and make personal, non-commercial use of the Site. You may not: resell or commercially exploit the Site/content; scrape, crawl, or use data-gathering tools; collect content for third-party benefit; use any content to develop/train/improve ML/AI models; upload malware; bypass security; reverse engineer; post unlawful/abusive content; infringe others’ rights; or impersonate others.
5.3 Termination or Suspension
We may suspend or terminate accounts/access for violations, fraud, abuse, or risk to our systems/customers. We may provide notice where feasible but may act without notice to protect our rights or others.
6. Terms of Sale
6.1 Order Acceptance & Cancellation by Us
Order acknowledgments are not final acceptance. We may refuse/cancel any order, including for availability limits, pricing/product errors, or credit/fraud concerns. In the event of pricing or availability errors, we may cancel any affected order or contact you for confirmation before processing at the correct price.
6.2 Customer Responsibilities
Order Verification: Verify all details at purchase. Changes (including size/customization) must be requested within 24 hours. Price differences will be charged/refunded. After 24 hours, the original order proceeds.
6.3 Payment Terms
We accept major cards and other methods shown at checkout. You represent authorization to use the payment method and authorize charges for the order, taxes, shipping, and fees. Prices are in USD and may change without notice.
Taxes & Duties. You are responsible for all applicable sales/use taxes, VAT/GST, import duties, customs fees, brokerage charges, and other governmental assessments, which may be collected at checkout or upon delivery depending on destination.
6.4 Cancellation by Customer
Within 24 hours: No cancellation fee.
After manufacturing begins: No refunds accepted
7. Shipping, Delivery, and Returns
7.1 Shipping Terms
Most items are kept in stock in our warehouse. Custom items will be given timeframes on a case by case basis.
Regular orders: 1-2 weeks
Large/custom orders: 10–14 weeks approximately
Timelines are estimates. Tracking activates once the carrier picks up your package. Weather/logistics delays may occur; we’ll email updates.
7.2 Delivery Instructions & Risk of Loss
Purchases are under a shipment contract. Title and risk of loss pass to you when we deliver items to the carrier. Extra fees may apply for Canada, Alaska, Hawaii, Puerto Rico, remote areas, or complex deliveries. Provide a valid phone number and special instructions. Ensure adequate access/clearances. Property damage/disputes with delivery personnel are between you and the delivery vendor; we’ll help coordinate where feasible.
7.3 Damages
Items are inspected and well-packaged. If damage occurs, note it on the delivery receipt, photograph it, and contact us within 24 hours. Remedies may include repair, partial/full replacement, or refund, as applicable. If you cannot inspect at delivery, please notify us within 24 hours of discovery and keep all packaging. Failure to note damage at delivery does not waive rights that cannot be waived under applicable law.
7.4 Limited Warranty; Returns
We provide a limited 1-year warranty covering manufacturing and workmanship defects for items in new or slightly used condition. The sole remedies are repair, replacement (in whole or part), or refund, as we determine. We do not accept “change of mind” returns. Natural variations, reclaimed wood traits, and customization nuances are not defects. We may evaluate concerns case-by-case and offer appropriate resolutions.
8. Intellectual Property Rights
Site content (text, images, graphics, logos, designs, product photography, software, and layout) is owned by Her Vanity or our licensors and protected by law. Personal-use license only; no reproduction, derivative works, or commercial exploitation without prior written consent.
9. User Content (Reviews, Photos, Feedback)
You retain ownership of content you submit. You grant us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, create derivative works, publicly perform/display, and distribute such content to operate, improve, and market our products/services (including Site, email, social, catalogs, ads). You represent you have necessary rights. We may decline/remove content with or without notice. We will honor reasonable requests to remove User Content that includes personal information where required by law or our Privacy Policy.
10. Data Privacy, Session Replay, and Communications
10.1 Privacy
See our Privacy Policy for details. We do not sell or rent your personal data.
10.2 Browsing Session Information
We may use session replay, chat transcripts, cookies, pixels, and similar tools to capture interactions for quality control, support, security/fraud prevention, and marketing per our Privacy Policy.
10.3 Your Access and Control
Contact us to access, correct, or delete data (processed within 30 days where applicable) or to opt out of marketing communications.
10.4 SMS Terms and Conditions
By opting in, you consent to receive marketing and transactional SMS/MMS messages from us at the mobile number provided. Message frequency varies. Autodialer or non-autodialer technology may be used. Consent is not a condition of purchase. Reply “STOP” to opt out or “HELP” for help. Message/data rates may apply. Carriers aren’t liable for delayed/undelivered messages. If you change or deactivate your number, please notify us.
11. Product Pricing, Special Offers, and Inaccuracy Disclaimer
11.1 Pricing
Site prices are in USD (unless stated otherwise) and may differ from other channels. Prices/availability may change without notice.
11.2 Special Offers
Promotions (e.g., gifts with purchase, free shipping) may be time-limited and subject to conditions. “Exclusive/only at” may refer to specific finishes, sizes, or versions. Unless expressly stated, promotions, discounts, and offers cannot be combined and are not transferable or redeemable for cash.
11.3 Inaccuracy Disclaimer
The Site may include errors/omissions (e.g., descriptions, pricing, availability). We may correct/update at any time without prior notice (including after order submission). If you prefer not to proceed after a correction, contact us promptly to discuss options.
12. Disclaimers & Limitation of Liability
THIS SECTION LIMITS OUR LIABILITY.
THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, REVENUE, OR DATA) ARISING FROM OR RELATED TO YOUR USE OF THE SITE, PRODUCTS, OR SERVICES, INCLUDING SHIPPING/CUSTOMS DELAYS OR FORCE MAJEURE, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE.
Some jurisdictions do not allow certain exclusions/limitations; some rights may not apply to you.
13. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Her Vanity and our officers, directors, employees, and agents from and against claims, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, misuse of the Site, or violation of law/third-party rights.
14. Informal Dispute Resolution
Before arbitration or suit, the parties will attempt to resolve disputes informally. Send written notice describing the dispute and relief sought to: Her Vanity – Legal Dept., 51 Nitram Street, Suite 500, Jacksonville, FL 32211. The parties will confer in good faith (phone/video) within 60 days. Limitations/filing deadlines are tolled during this process.
15. Arbitration Agreement; Waiver of Class Actions & Jury Trial
Except for qualifying small-claims matters or provisional relief, any claim arising out of or relating to these Terms or the Site will be resolved by final and binding arbitration under the AAA Consumer Arbitration Rules. The FAA governs this section. The arbitration will be conducted by a single arbitrator in English, with venue in Florida (or via video at the arbitrator’s discretion). YOU AND HER VANITY WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION. Proceedings are confidential to the extent permitted by law. The arbitrator may award the same relief available in court on an individual basis and may reallocate fees as permitted by law/AAA rules. Either party may elect small-claims court; if arbitration has begun, the electing party will promptly withdraw in favor of small-claims court.
Delegation. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this Arbitration Agreement, including any claim that all or part is void or voidable, except that a court may decide issues regarding the enforceability of the class-action waiver or public-injunctive relief to the extent required by law.
Severability (Arbitration). If the class or representative action waiver is found unenforceable as to any claim, then that claim (and only that claim) must be litigated in court, not in arbitration. If any other provision of this Section is found unenforceable, the remainder remains in force.
Survival. This Arbitration Agreement survives termination of these Terms and your relationship with us.
15.1 Mass Arbitration Process Requirements
If 25+ similar claims are brought by the same or coordinated counsel, claims may proceed in staged batches with good-faith global mediation between batches. Statutes of limitations and filing deadlines are tolled for claims subject to batching from selection until a claim proceeds, is withdrawn, or otherwise resolves. A court may enforce this section. If any part is deemed unenforceable, the parties will cooperate in good faith (with a process arbitrator if available) to devise fair, efficient procedures.
16. Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, acts of God, war, terrorism, labor disputes, government actions, or network failures).
17. Hyperlinks to Other Sites
We may link to third-party sites/resources. We are not responsible for their content, availability, or practices. Access at your own risk.
18. Open Source
Some components may be provided under open-source licenses. Your use is subject to applicable open-source license terms.
19. Changes to Terms
We may update these Terms from time to time. We will post updates here and may also notify you by email or Site notice. Continued use after posting constitutes acceptance.
20. General Provisions
Severability: If any provision is unenforceable, it will be limited/eliminated to the minimum extent necessary; the remainder stays in effect.
No Waiver: Failure to enforce a provision is not a waiver.
Assignment: We may assign our rights/obligations (e.g., merger, acquisition, sale of assets/equity, or by law). You may not assign without our written consent.
Electronic Communications & Notices: You consent to receive electronic communications from us (e.g., email, site notices). Such communications satisfy any legal requirement that they be in writing. Keep your contact information current.
Governing Law; Venue: Except as preempted by the FAA, Florida law governs. Where arbitration/small-claims does not apply, the state or federal courts located in Duval County, Florida have exclusive jurisdiction and venue.
